governance: make stale-source handling operational #22

Description
Context
The answering workflow requires a stale-source check, but the corpus defines neither a refresh deadline nor a deterministic consequence:
ANSWERING-GUIDE.mdtells the agent to recheck stale or pending material.AGENTS.mdpermits a stale memo to retainansweredorpartialstatus.COVERAGE.mdlists refresh triggers but leaves cadence unresolved.- Every current record shares one
last_verifieddate, regardless of source volatility.
A pending docket, mutable license text, statute, official registry, foreign translation, and historical final judgment do not age at the same rate. Without an operational policy, an AI can call an old answered memo current after a silent legal or docket change.
Proposal
Define source-class freshness rules and an abstention/recheck decision table. Add structured freshness metadata such as freshness_class, review_due, and a pending-docket flag. Expose stale state in indexes and require current-law verification before an overdue or unknown record supports an unqualified answer.
Acceptance criteria
- The repository defines freshness classes and review cadence for statutes/rules, pending cases, final cases, official license/steward status, settlements, and foreign/translated material.
- Matter and authority templates contain the selected freshness metadata.
- Existing records receive a due date/class or an explicit
unknown/recheck-requiredstate. - A validator identifies missing and overdue records and surfaces them in the canonical indexes.
- Deterministic retrieval tests show that overdue, pending, or unknown sources force a qualified answer and current-source check.
- Refreshing a record requires checking later history and updating its search log or history, not merely changing a date.
- Legal-review status remains separate from freshness.
Decisions
- Confirmed governance defect, P1. This issue controls reliance timing; it does not alter substantive legal propositions.
- Different cadence by source class. One global number would create false equivalence between volatile dockets and historical texts.
- Fail qualified, not silent. An overdue record may still be useful as background but cannot silently support a current answer.
Open questions
- Which attorney or corpus owner sets and approves each cadence?
- Must high-risk questions perform a live web/docket check at answer time even before
review_due? - Should CI fail on overdue records or only generate a blocking retrieval status?

Verdict
Leave open; the core deterministic-governance gap is confirmed, but the issue overstates the absence of safeguards and does not establish P1 urgency. This is a repository workflow/schema defect, not a new substantive legal conclusion. I did not need external merits research: the claim is testable against
origin/mainat40ee7108f4b46b6b8fb1976f5c8b3cd996bdfb42, the current issue/timeline, and the repository's own contract.Reproducible repository evidence
Existing safeguards that narrow the claim:
ANSWERING-GUIDE.md:13-14already requires rechecking pending cases, current statutes, official-license status, and stale dates before relying;authorities/INDEX.md:124-125repeats that current-answer gate.PROPOSITION-MAP.md:18-38makes a recheck column part of every route. Its AGPL network-only route expressly requires current dockets, decisions, state law, and license text.Recheck trigger:.AUTH-0005(sfc-v-vizio.md:7,62-63) is structured asauthority_status: pendingand says to verify status before every use.AGENTS.md:51-52forbids updatinglast_verifiedwithout checking all time-sensitive authorities, and its quality gate at lines 135-140 requires recent checks of current cases and statutes.README.md, andINDEX.md; that acceptance criterion is preservation of an existing invariant. The deterministic gap nevertheless reproduces:
templates/MATTER.md:19andtemplates/AUTHORITY.md:17provide onlylast_verified; the authority template's later-history/recheck entries are prose.INDEX.mdandauthorities/INDEX.mdexpose verification dates but no computed current/overdue/unknown state. The only executable validator istools/license_headers.py, and every test intests/test_license_headers.pyconcerns source headers, artifacts, or the separateLEGAL-REVIEW.mdrelease gate..github/workflows/test.ymlruns those tests/lint/type checks but has no research-freshness check. Thus no executable path can decide when a date becomes stale or translate stale/pending/unknown into a retrieval disposition.GitHub/history checks found no duplicate or resolution: issue #22 has no linked/cross-referenced resolving PR, its timeline contains only the #19 parent relation, relevant searches find only #22 and its parent, and
origin/mainhas no commit after the issue was filed. The corpus landed in PR #18 with the unresolved cadence question still present atCOVERAGE.md:96-105.Overbroad or underspecified parts
2026-08-25date is not itself evidence of bad cadence; all records were imported/verified in the same corpus pass that day. It proves the schema cannot express differential future treatment, not that a record is presently stale.AUTH-0005and ubiquitous event-driven triggers. The defect is that these are inconsistently machine-readable and non-computable, not that no safeguards exist.pending_docketmay duplicate and later contradictauthority_status,procedural_posture, and prose later history. Define a normalized lifecycle/freshness model instead of requiring that exact field.review_due.Additional information needed

Repository defects (testable):
unknown/recheck-required; preserveresearch_status,legal_review, and authority posture as distinct dimensions.--as-of YYYY-MM-DD(and stable machine-readable output) that validates dates/classes, detects overdue/unknown/pending-every-use records, and rejects contradictory metadata.current,recheck-required,qualified-background-only, orblocked; wire the answering guide to that result. Do not claim an AI is “forced” unless an executable consumer actually enforces it.Policy recommendations requiring owner/counsel decision:
